Making a Claim - Public Liability and Professional Indemnity
What you must DO immediately after the loss or damage
- Take all reasonable steps to prevent further loss, damage or liability.
- Write down and record the name and current details of the person who may make or has made a claim for compensation against you.
- Write down and record the current name, address and phone number of any witnesses to the accident.
- Obtain written statements from any witnesses to the incident.
- Record the incident in n incident report setting out what has occurred in as much detail as possible.
DO NOT
- Do not admit liability either verbally or in writing if an incident occurs which is likely to result in another person making a claim for compensation against you.
- Do not make an offer, settlement or promise of payment without our prior written consent.
- Do not incur any costs or expenses without our prior written consent, in respect of any right or claim.
Making A Claim or Notifying Us Of a Possible Claim
- Promptly contact Affinity Insurance Brokers on 1300 131 366, on Monday to Friday between the hours of 8.00am – 5.30pm to report the loss, damage or incident and obtain further information about what to do next, including information advising what documentation will be required from you.
- Obtain a claim form for completion and return to our office. This may be downloaded from this website, or otherwise the claim form can be posted, faxed or emailed to you upon request.
- Complete and return the claim form to us within 7days together with any information or documentation such as incident reports, witness statements, police reports, risk management guidelines which will assist us with defending the claim on your behalf. We may arrange for an investigator to attend at your premises to investigate the circumstances of the claim or potential claim.
Excess
An excess is the first amount, which you must pay towards each claim. This amount is shown on your schedule. Before we pay a claim you must pay the total amount of the excess to our office or to a person or company to whom we direct you to pay it. Eg a solicitor.
Co-Operation
If an event occurs which may give rise to a claim being made against you, you must:
- Supply us with all the information we require to settle or defend the claim on your behalf.
- Send to us immediately any letter, notice, claim, Writ, Complaint or communication from other parties in which a claim is made or threatened or intimated.
- Not speak to, negotiate, make payments or settle a claim without our prior written consent.
Action By Us
When we receive a claim from you we will examine the circumstances of the incident and tell you if you are covered.
If your claim is covered and payable by us, we may arrange for an investigation of the circumstances and we may settle or defend the claim on your behalf subject to the terms and conditions of your policy wording.
